Step 1: Determine the type of work to be registered for copyright
The types of works that can be registered for copyright are divided into various categories. Depending on the work, it will be registered in different forms.
The specific types of works eligible for copyright registration are as follows:
a) Literary, scientific works, textbooks, teaching materials, and other works expressed in written form or other characters;
b) Lectures, speeches, and other oral presentations;
c) Journalistic works;
d) Musical works;
đ) Dramatic works;
e) Cinematic works and works created using similar methods (hereinafter referred to as cinematic works);
g) Fine arts, applied arts works;
h) Photographic works;
i) Architectural works;
k) Charts, diagrams, maps, drawings related to terrain, architecture, scientific works;
l) Literary, artistic folk works;
m) Computer programs, data collections.
Step 2: Prepare documents and information required for copyright registration
After determining the type of work to be registered, the owner or the authorized person will prepare the necessary documents and information for copyright registration.
Step 3: Prepare the copyright registration application
The application for copyright and related rights registration includes:
- The latest copyright registration form
- 02 copies of the work to be registered for copyright or 02 copies of the formatted version for related rights registration. For example: A written work: 2 printed copies on A4 paper with page numbers...
- An original Power of Attorney;
- An original signed Statement of Honesty of author(s) on creation of work;
- A notarized copy of Certificate of Business Registration of the Owner (legal entity owner) or notarized copy of the Owner’s ID or passport (individual owner) and legalization is required in case the author is foreigner);
- A notarized copy of the author’s ID or passport [legalization is required in case the author is foreigner];
- Two printings of EACH work [It must show the name of work, owner and be sealed with company stamp];
AND one of the following documents:
- An original signed declaration of the author [In case the author is the owner];
- An assigned decision [In case the staff of the company/the owner is assigned tasks to design the art work];
- A notarized copies of contract of lease of design [In case the owner hired a third party to design the art work].
Step 4: Submit the application for the certificate of copyright
The author, copyright owner, or related rights owner can directly submit the application or authorize another organization or individual to submit it to the Copyright Office in Hanoi for those in the northern region. For those in the central or southern regions, the application can be submitted to the Copyright Office branches in Ho Chi Minh City or Da Nang.
Step 5: Track the copyright registration application after submission
Once the application has been successfully submitted, the experts will examine the file before issuing the certificate. During the examination process, the experts may require the applicant to modify or supplement the application to ensure its validity.
Step 6: Receive the copyright registration certificate
Once the application is reviewed, verified, and deemed complete and valid, the Copyright Office will issue a registration certificate to the owner to acknowledge their ownership rights.
